Alert: We are getting a record number of hits and inquiries about Militias

We recommend organizing a local NET-Militia and GET READY!

Find someone you trust first, then set up Neighborhood Emergency Teams, then get more fully prepared with food, water, medical, communcation and counter-measure and security.  It will sound better and won't scare people under a different name.  The word "Militia" is a trigger word.  Helping others in your neighborhood get prepared is far more friendlier than just organizing a militia.  They will be closest and the first ones to help you and you help them.  Be watching for a major stock-market crash in October just before elections!  It will make the 1929 crash look like a Sunday School picnic.

A Call to Organize Constitutional State Standby Militias

"Who are the militia? Are they not ourselves? Is it feared, then, that we shall turn our arms
each man against his own bosom? Congress shall have no power to disarm the militia.
Their swords, and every other terrible implement of the soldier, are the birthright of an
American ... The unlimited power of the sword is not in the hands of either the federal or
state governments, but where I trust in God it will ever remain, in the hands of the People."

-- Tench Coxe, 1788.

We demand, as a deterrent against any outside aggression and internal insurrection, that each state governor initiate immediate action to establish and organize, train and arm all able bodied men (ages 18 to 65) into STATE STANDBY MILITIAS in accordance with the united States Constitution and the Constitutions of the various states.

Constitutional Requirements for the establishment of a Lawful Militia

1.    The governor has the authority to ONLY appoint one senior commanding officer.  All other Commissioned Officers and Non-Commissioned Officers shall be chosen through the elective process by the vote of the individual members of each militia.

2.    Each member of each militia shall be sworn to uphold, defend and protect the Original Constitution of the united States of America and the Constitution of the state he represents against all enemies foreign and domestic.

3.    ONLY in the event of a Constitutionally Declared War shall the militias be transferred to Federal Military Jurisdiction.  All militia members must remain under the direction of those officers whom they have elected.

4.    Under No circumstances shall the members of the militias or the Federal Military Organizations be directed or controlled by any foreign government or agency.

5.    The militias shall not be placed under any Federal Military Leader who is not sworn to uphold the Constitution of the united States of America.

6.     Every able bodied man (ages 18 - 65) shall be issued, and required to have at least one rifle and 20 rounds of ammunition.

Our present MAJOR GOAL is to encourage the establishment of Constitutional State Militias. Whereas, the governors of the various states have forsaken their duty and responsibilities to maintain our Republic form of government in their various states.  Therefore, we feel the urgency of our establishing independent neighborhood watch and emergency defense teams in preparation against any major terrorist movements against our communities, towns and cities, with biological, chemical or even the possibility of radiological (atomic) attacks on our major populated areas.

Many of such neighborhood organizations have already been established in most of the rocky mountain states and several of the other western, central and eastern states.

It is a certainty when such attacks come that the NEW WORLD ORDER, under the military force of the United Nations, will try to establish total military control over our Nation through martial law. This would be the attempt to deprive us of our Constitutional Rights to keeps and bear arms, to free movement, to the publication of educational and organizational materials and even the right to assemble without the permission of BIG BROTHER. WHICH IS TOTAL TYRANNY.

We, the Citizens, who are the ultimate government authority of this Nation, will make these proper preparations as outlined in the previous publication, there will already be a program in our area to deal with such terrorist activities on our own. Such actions on our part would help to preclude the excuse and the need for martial law and control over us by the BEAST. (See Chart Militia Neighborhood Emergency Teams )

Because a well-armed citizenry is the best Homeland Security, and can better deter crime, invasion, terrorism, or tyranny...

General Elements of a Militia Organization

The "unorganized" or reserve militia is a legal and lawful part of the armed forces of this nation. It is a military organization recognized by the Second Amendment of the Constitution; Title 10 Section 311 USC; The Dick Act of 1903; The National Defense Act of 1916; and affirmed by numerous court decisions.

There is no ambiguity, the "unorganized" citizens militia is not the National Guard or the state "select" militia under the governor, or part of the "organized" armed forces of the federal government. It is literally the entire body of the armed citizenry.

Although the "unorganized" militia can be called up for lawful (Constitutional) purposes, it is not under the direct control of any state or political jurisdiction. It represents the authority and power of the people over the government and stands as the last defense of the citizens of this country against any domestic tyrants.

Purposes and Authority of the Militia:

The purpose of the militia as defined by the Constitution is to:

1. Enforce the laws of the Union (The Constitution)

2. Suppress insurrections

3. Repel invasions

These provisions affirm the right of the people to defend themselves and their republican form of government from all enemies, both foreign and domestic. That means that the people, as the militia have the right to fight, if necessary, oppressive government, to prevent the usurpation of the Constitution (the supreme law of the land) by anyone, including the federal government.

The authority, duty, and obligation of the citizens, acting as the militia, is clearly expressed in our Declaration of Independence: "That whenever any form of government becomes destructive to these ends, it is the right of the people to alter or abolish it..., " further "... it is the right, it is their duty, to throw off such government,..." Together these provisions codify the natural rights of all citizens to defense of self, family, and country.

"The strongest reason for people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government." -Thomas Jefferson

Membership:

With the exception of certain public officials, all able-bodied men between the ages of 17 and 45 not currently serving in the regular armed forces or National Guard, and any former member of the regular armed forces, are by law already members of the "unorganized" militia. Law requiring militia participation are no longer enforced.

With very few restrictions, membership in the militia must be open to all citizens regardless of race, sex, religion or political affiliation. Units not open to public membership and/or which are organized for any purpose other than the support of Constitutional principals may be considered private armies and are not to be confused with the Constitutional "unorganized" militia.

As a practical matter, effort should be made to incorporate only citizens of good character in the militia. Those who advocate criminal activity, terrorism, revolution, or a change from our republican form of government should not be tolerated. This implies that militia members should understand the duties and obligations of both citizens and government under out Constitution.

Elements of Militia Organization:

The basic elements necessary for the formation of a militia unit include an organizational meeting which is open to members of the public; an affirmation and consensus on the purpose of the organization; and the election of officers.

The distinction between a political action group organized to promote Constitutional government and a militia is the military orientation and a political orientation of the latter. Both groups must work together in support of mutual goals. Individuals may participate in both. But, the militia prepare, train, and equip as a response group in fashion of minutemen of Concord and Lexington for the defense of self and community.

Therefore, to be recognized as a militia unit, the organization should adopt a written code of conduct and organization, have a distinctive uniform or method of identification, and implement a training program to fulfill the "well-regulated" disciplinary requirement of the Second Amendment.

Supplemental Guidelines:

The militia is the natural adversary of those who promote the socialist New World Order and pervert our republic form of government without the approval of the people. Those who stand in the gap between the people and the constitutional world government invite censure and conflict.

The militia does not stand alone. Whenever possible units should work to enlist the support of the community, auxiliary members, and law enforcement. Militia units should in turn support their local elected officials, sheriff, or police force in the lawful exercise of their authority.

The militia embodies the spirit and ideals of our forefathers and is comprised of men and women who are committed to defend our Constitutional Republic. An unquenchable patriotic spirit compels us to stand for the individual freedoms, liberty, and sovereignty guaranteed by our Constitution. The militia must stand for what is moral, lawful and right if it is to prevail in adversity.

Column/Guest editorial #3 by Jon Roland, Constitution Society, 210/224-2868, May 8, 1995

The Constitutional Militia

A century ago most people understood what the term Militia meant, but after decades of neglect, that understanding has been largely lost, so that now most people are unclear on the concept. It is unfortunate that it has taken the tragedy in Oklahoma City to revive interest in the concept, especially considering the way that incident has been used to stigmatize the term.

When people join to form a society, one of the main reasons they do so is for mutual defense. They pool their individual rights of self-defense into a mutual duty to defend one another. They are not relieved of that duty when they form a government and delegate defense duties to officials. Delegation is not a transfer, but appointment of an agent, who is delegated no authority or powers not held by the people, which they retain and may exercise at any time their agents fail to do so.

Essentially, a militiaman is any citizen in his capacity as a defender of the state. By "state" we do not mean "the government", but a community of citizens in possession of a territory. A citizen whose behavior makes him an enemy of the state is not a militiaman, because he cannot both defend the state and attack it at the same time. Furthermore, he may have official duties, such as serving in an executive, judicial, or legislative position, or as a member in the armed forces, which take precedence over general militia duties. Therefore, in the broadest sense, the Militia is all citizens who are not enemies of the state and who do not have official duties that take precedence over their militia duties. That may include officials when they are off-duty.

If you defend yourself against a criminal attack, what you are really doing is not just defending yourself. You are calling up the militia, consisting of yourself, to defend a member of the community, also consisting of yourself, and thereby forming a militia of one. If you ask someone else to help you, you are calling up the militia consisting of the two of you.

Although every citizen has the duty to defend the state, that duty extends only as far as he is able to carry it out. No one has the duty to do what is impossible for him. On the other hand, he has the duty to exercise his abilities to make them as great as he can. His duty does not begin when a situation arises that requires him to act. He also has a duty to prepare to respond to any reasonably foreseeable contingencies.

Since situations requiring the response of many citizens require that they act in concert, and not as an aimless mob who get in each other's way, citizens also have the duty to prepare themselves to work in concert with their neighbors to meet any foreseeable contingency. This leads to the requirement that citizens, in their capacity as militiamen, have the duty to organize and train themselves and maintain themselves in a high state of readiness. This is what the U.S. Constitution meant by the term "well-regulated" in the Second Amendment. Contrary to some contemporary disinformation about that term, the original meaning, and the meaning that matters in interpreting the Constitution, is organized and trained. Not necessarily by public officials. Most of the militias to which the term was applied during the period the Constitution was written were independent of official control, electing their own commanders, although this was commonly the locally-elected sheriff.

The Framers feared two things: large standing armies and select militias. A select militia was an armed group formed not from the entire population of a jurisdiction by public notice, but selected by some method that might make them unrepresentative of the community, and a threat to lawful government or to the community. A regular standing army or police force is always a select militia, and it may serve the will of those in power, and be used against the people. Therefore, the Framers intended that the militia should always be able to prevail over the government and its armies or select militias. They did not trust those in power to voluntarily refrain from corruption or the abuses that attend it. The Militia was seen as one of the checks on the power of government, like division of powers between the central and state governments, between the executive, judicial, and legislative branches, and between the two houses of the legislative branch.

Of all the countries in the world, only Switzerland now has a militia system similar to what the Framers intended for this country. There every able-bodied male in a certain age range is required to regularly report for training, and to keep a weapon in his home suitable for militia duty. Presently, that is a full-automatic rifle. It is no accident that Switzerland has never been invaded in modern times, or that it has one of the lowest crime rates of any modern country. The militia training every male Swiss citizen receives not only prepares them for defense, but serves to build the bonds of community that are threatened by modern urban life.
